TERMS AND CONDITIONS
The company EcoTime Factory, whose registered office is located in Belmont s / Lausanne, registered in the Commercial Register of the Canton of Vaud, in Moudon under number CH 550-1065403-5 February 23, 2010 and published on the SOGC has for activity the operation of a service, concierge, transportation and event organization company. www.ecotime-factory.ch, contact@ecotime-factory.ch and for address 7, Chemin Ruèyres 7, 1092 Belmont s / Lausanne.
Once a company or an individual has subscribed to a subscription described below, the subscriber can register on the customer area of the site www.ecotime-factory.ch. The beneficiary can reach the page of services with all our services that will be provided through EcoTime Factory, which acts mostly as a mere intermediary in the relationship between subscribers (acquirers) and suppliers of products or service providers (sellers).

ARTICLE 1 - APPLICATION OF THE TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale available on the website www.ecotime-factory.ch are systematically accepted by each customer. By his agreement, he also agrees to receive the monthly newsletter and the offers of our service providers in a monthly e-mail. The terms and conditions can be modified and the new French version will prevail. Consequently, any order made by the customer carries its adhesion, without restriction or reservation, to these General Conditions of Sale, which prevail over all other documents (prospectuses, catalogs ..) issued by EcoTime Factory. Any other condition opposed by the customer will be, in the absence of prior written and express acceptance by EcoTime Factory, unenforceable against the company, regardless of when it may have been brought to its attention. If EcoTime Factory does not avail itself punctually of any of the provisions of these General Conditions of Sale, this tolerance cannot be interpreted as a renunciation to avail itself later of any one of these conditions. The customer declares to have read, understood and accepted the following Terms and Conditions of Sale before placing any order for products or services.

ARTICLE 2: SUBSCRIPTIONS
There are three optional subscriptions for companies: "Online" subscription, "On site" subscription, "VIP Privilege" subscription. There are two private concierge subscriptions: "Online" subscription, "VIP Privilege" subscription. All subscriptions are annual and without written request of withdrawal of the customer by registered letter one month before its expiry, are renewed from year to year. Any cancellation request will be handled case by case without any obligation for EcoTime Factory to accept any refund. Only the "Privilege VIP" subscription can be suspended during holidays or a minimum of fifteen days' travel. The hours of presence or closure, the religious holidays, cantonal or national will be announced at the beginning of the year. During holiday periods, a limited schedule may be set up. No deduction of the subscription price will be made to customers for these closures. By subscribing to an individual subscription or subscription in enterprise, the customer agrees to receive monthly our Newsletter and offers of the month. We guarantee that no information about our customers will be disclosed to a third party to be used for commercial purposes.

ARTICLE 3: ORDER
To place orders, the customer who has subscribed or the employee benefiting from a program of assistance of his company, certifies to be over 18 years, to have his full legal capacity, to confirm the accuracy of the data provided and may use the following means for personal orders, non-transferable (the deposit of personal effects is an order except for an express request for quotation)
- via the Internet, on the website www.ecotime-factory.ch on "Customer Area"
- by phone at the mobile phone number of his concierge (only VIP Privilege subscriptions)
- by email to the specific address for customers

Registration procedure for a new corporate client on the "Customer Area":
1. The employee clicks on "Customer Area", inscribes the name of the company to be accepted as a customer
2. EcoTime Factory validates the registration. The employee receives an e-mail with a code allowing the consultation of the services
3. The customer acquires and adheres to the general terms and conditions

Registration procedure for a new private customer on the "Customer Area":
4. The future private customer clicks on "Customer Area" and subscribes as a private subscriber
5. The customer receives an email from EcoTime Factory with the different subscriptions of choice. The customer subscribes by indicating the place of delivery of the products / services ordered (office or / and house) which define the delivery prices. He makes the payment of his subscription according to the chosen modalities online
6. The customer acquires and adheres to the general terms and conditions
7. Once the amount of the subscription paid, the subscriber receives a code by email allowing him to place an order in "Customer Area"
Rules applicable to orders in general : Before taking any order, the customer must give EcoTime Factory his personal and/or professional address, email address, telephone number which will allow EcoTime Factory to contact him quickly. Once the subscriber has been accepted as a customer or the employee benefiting from a program of his company has received his code, he can place an order. The orders of products or services formed by the customer will be transmitted to the partners through EcoTime Factory. Delivery and transport costs are based on the delivery location chosen by the customer. The price may vary depending on the selected area and the provider responsible for covering it.

Acceptance of the order by the customer: The customer must imperatively confirm his order by online secure payment. Orders subject to quotation will be final after receipt by EcoTime Factory of their acceptance by payment of a deposit or the amount set and delivery will take place after payment of the full amount of the estimate (car repair, events ...). The photos and text of the website are not contractual and are given for information only. EcoTime Factory will transmit to the customer all the useful information inherent to the order.

Broken stocks or services available from suppliers and service providers: All orders are subject to availability of stocks or services available from the supplier/s and service provider/s. The customer will be contacted and alternative solutions will be proposed to him as soon as possible in case:
- Out of stock or unavailability of products or services ordered
- modification of the nature of the product or service ordered
- modification of the price of the service or product ordered by the customer
- change of the price of the service or product previously indicated by EcoTime Factory to the customer
- modification of the delivery time previously indicated by EcoTime Factory to the customer

The proposed alternatives will be implemented upon receipt of a written agreement returned by the customer. In the event that no alternative solution would be found or accepted by the customer within 5 working days after having known about it, the company EcoTime Factory would proceed to the outright cancellation of the order. No compensation of any kind whatsoever can be charged to EcoTime Factory by the customer as a result. In the event that a payment has been made, it will be refunded in case of cancellation of the order, transaction fees deducted from the refund.

3.1. Special conditions for smartphone repairs
For objects at risk, our partner will request a validation of the owner of the object or even refuse the repair and declines any responsibility in case of damage following the repair. All repairs are guaranteed twelve months on the job and six months on the changed parts only, except the battery which is a consumable. This warranty is not valid for another defect that should occur on another part / function in the future of which our partner could not be held responsible (modification of equipment, abnormal use (eg the Smartphone should not be worn in the back pocket of the pants to prevent it becoming fragile and that the glass cracks or breaks again), accident, shock, deliberate deterioration, damage caused by water, fire, moisture or lightning. Waterproofing is not guaranteed after repair even for so-called waterproof devices. A minimum of 10% of the remaining battery of the Smartphone is necessary to be able to carry out the tests. If this was not the case, our partner could not carry out these tests and cannot be held responsible after the repair done. The same applies for the loss of data that must be saved by the customer before repair. In case of data loss the intervention of the technician, our partner cannot be held responsible, whatever the value of the recorded data. The customer acknowledges having been informed that the intervention on his device may result in a breach of warranty of the manufacturer or distributor. Some shocks are such that disassembling the device may cause a failure that may be different from the original reason for support. Reparationsmartphone.ch "can under no circumstances be held responsible for causing the failure. The opening of a device is the responsibility of the customer. The Administrative Tribunal of Lausanne has sole jurisdiction for the settlement of any dispute. The device must be retrieved within 90 days after the fixed repair date. Otherwise, it will be eliminated and it will no longer be possible to recover it.

3.2. Special conditions relating to laundry / cleaning / laundry / shoemaking / sewing
Any article without a label loses any guarantee of cleaning in terms of colors, shapes or texture. We staple a similar number for the number of pieces of the same customer. The quantity of the effects listed upon arrival at our dry cleaning partner will prevail. The differences between the form filled by the customer and the count of our partner will be reported to the customer. For very fragile objects for which a discharge is necessary, a discharge will be requested by email to the owner of the object. Cleaning is dry unless the customer specifically requests a wet cleaning. In case of claim for loss or damage, the compensation paid by our partner cannot exceed the value of the object lost or damaged at the time of the damage counting with an annual obsolescence rate of 30%. The customer receives a Garment bag used for transport and identification at the price of Chf 10.

3.3. Special conditions for car cleaning
Our car cleaner declines any responsibility for marks or damage existing on vehicles but not announced by their owner. For objects at risk, it may request a validation of the owner of the object and refuse the cleaning of the vehicle.
In case of mishandling during the cleaning, our partner agrees to examine the films of the cameras in place controlling the work done and compensate the customer with or without his insurance in case of liability. The procedure (deadline, etc.) and the conditions specific to our partner, at his request, may be added to the ETF general conditions.
In case our partner increases its prices, ETF will be informed three months before the end of the year in order to be able to adapt the prices for the customers for the next year. The ETF customer will benefit from the special offers of the moment. It is specified that when our partner offers an attractive price, this one is offered in priority to ETF.

3.4. Special conditions relating to computer repairs
Warranty: In case of damage during the repair and claim, our partner agrees to compensate the customer with or without his insurance. For objects at risk, our partner will request a validation of the owner of the object or even refuse the repair and declines all responsibility in case of damage following the repair. All repairs are guaranteed 3 months (90 days), except the battery which is a consumable. This warranty is not valid on another defect that should occur on another part / feature in the future of which our partner could not be held responsible (modification of material, abnormal use, accident, shock, voluntary deterioration, damages caused by water, fire, moisture or lightning Waterproofing is not guaranteed after repair even for so-called waterproof appliances Our partner could not be held responsible for the loss of data that must be saved by the customer before repair, regardless of the value of the data recorded The customer acknowledges having been informed that the intervention on his device may result in a breach of warranty of the manufacturer or distributor Some shocks are such that the fact of disassembling the device can generate a failure that may be different from the original reason for taking care of it. Any opening of device is made under the customer responsibility.

3.5. Special Conditions for Car Rental
Mandatory: Driver's license valid for Swiss and international permits for foreigners.
Guarantee: deposit by credit card or cash (depending on the partner and on the shoe of his company)
Cancellation daily rental: 24 hours before the vehicle is taken at the latest
Monthly rental cancellation: one week before the vehicle is taken at the latest

Are not included in the rental price:
- The late return of the vehicle.
- Refueling of the vehicle at the time of return of the vehicle
- Fines of all kinds
- Transport insurance

Modification of the order by the customer
Any modification or cancellation of the order made by the customer must take place within a maximum period of 24 working hours upon acceptance of the quote to be taken into consideration by EcoTime Factory who will assess the cancellation request according to the nature of the products or services. In any case, any modification or cancellation of order by the customer is subject to the express acceptance of EcoTime Factory. In the event that EcoTime Factory refuses to proceed with the modification or resolution of the order requested by the customer, the amount paid at the moment of the order confirmation would be due by the customer, the sums already paid by the customer (price or deposit payment) would not be returned to him.

ARTICLE 4: PAYMENT OF ORDER
The price of the order: The products and services will be invoiced on the basis of the Price list of the partners precisely indicated, in Swiss Francs (CHF) and all taxes included, by EcoTime Factory.

Terms of payment of the order: The customer accepts in advance the terms of sale and delivery before paying directly to EcoTime Factory the deposit or the amount required under the conditions for each product by payment or secure payment directly on the website www.ecotime-factory.ch
In the case of payment by bank transfer or by payment to the EcoTime Factory account at the Raiffeisen Bank or PostFinance, the order is validated only after receipt of payment.

Payment Security: When the customer orders an item or service on our website, all payments made are secure. EcoTime Factory uses the payment system by credit card, payment by application on Smartphone and debit account. Payments can be made by credit card: VISA, MASTERCARD and TWINT. Secure credit card payment procedures rely on the data encryption protocol.
These procedures, managed by computer engineering, consist of encrypting the information on the terminal, even before they are transferred via the Internet. Any request for payment made through our secure online payment system is payable upon receipt.

Late payment: The customer accepting the Terms and Conditions, will be charged a reminder fee:
3 reminders generated by the PAYREXX system requesting payment: Chf. 10.-
5 reminders generated by the PAYREXX system requesting payment: Chf. 20.-
After sending 5 reminders to a subscriber, the next orders may not be taken into account without full payment before delivery.

Any amount not paid when due on an invoice will automatically, and without prior notice, penalties of 1.5% per month, as well as the application of default interest at the legal rate. In case of late payment by the customer, orders or deliveries in progress may be canceled without prior notice or prejudice any compensation and / or course of action. Any inherent costs related have to be paid by the customer.
Failure to pay: Failure to pay an invoice on its due date authorizes EcoTime Factory to cancel orders or delivery in progress, without prior notice or prejudice to any compensation and / or course of action and without prejudice to the recovery of sums remaining due by the customer.

ARTICLE 5: DELIVERY
Delivery conditions
The conditions of delivery of the product or service ordered are fixed at the time of the order. The delivery by EcoTime Factory, products or services ordered by the customer does not under any circumstances assume that the sale is made directly by EcoTime Factory which often intervenes only as an intermediary in the relationship between subscribers and suppliers. Depending on the products or services, the service provider may be in charge of the delivery.

Delivery times and delivery costs are indicated on the product or service form under "Customer Area" or on the quotation that the customer receives. The shipping method depends on the nature and volume of the order. The customer accepts the special conditions of the general conditions for each service / product at the time of the order. If the customer wants a specific delivery method, he must make the request at the time of the order by assuming to pay the price.

Terms of delivery
“Individual” customers

Customers with a corporate subscription
Deliveries of pressing, shoemaking and baskets of fruits and vegetables are included in the price offered and are made twice a week. For other services, a delivery package will be communicated at the moment of the order and may fluctuate depending on the partner operating the delivery.

The delivery times
Delivery times will be indicated when ordering. In spite of all the care given to the strict observance of the agreed deadlines, EcoTime Factory cannot be held responsible for the damages or prejudices caused by a delay during the delivery of a product or a service. Failure to comply with agreed delivery times will not result in any compensation of any kind to EcoTime Factory.

ARTICLE 6 : RESERVATION OF PROPERTY AND TRANSFER OF RISKS
EcoTime Factory suppliers will retain ownership of the products until paid in full. The products ordered will however travel at the risk of the customer; no derogation can be made to this rule. In case of damage, loss or missing, it is up to the customer to make all necessary to notify the shipper. When transporting vehicles belonging to customers and carried out by an EcoTime Factory employee, it declines all responsibility in case of damage.

ARTICLE 7 : LIABILITY
The customer expressly admits that EcoTime Factory, as a broker and more generally as an intermediary, is only bound by an obligation of means. EcoTime Factory therefore cannot incur, for any reason, any compensation of any nature whatsoever, only the responsibility of the supplier can be engaged.
The customer will therefore directly address the supplier of the service or product concerned any claim for compensation or any other request for the product or service ordered through EcoTime Factory to claim compensation. EcoTime Factory is exempt from all liability relating to the execution of the sales contract and the delivery of the products and services ordered. EcoTime Factory may send to the supplier the letters of complaint thus addressed by the customer. In any case, EcoTime Factory cannot be held responsible for the non-fulfillment of its obligations in case of force majeure defined by the Civil Code, and particularly in case of total or partial strike, flood, fire, computer failure etc (Non-exhaustive list).

ARTICLE 8 : Data Protection Statement (GDPR)
The Delegate to the processing of collected data on the customer area and the website portal www.ecotime-factory.ch within the meaning of the Basic Data Protection Ordinance (RGPD) is responsible for enforcing the confidentiality of your data and guarantee you to exercise your rights. Data tracking documentation must be kept up-to-date with the list of people with access (treatment). Data such as name, address, e-mail address, telephone, company, as well as all other data necessary to identify the customer and to deliver the services by our partners or ourselves, are communicated by the customer when registering as a subscriber or when ordering a service. This information is entered, processed and used in compliance with the provisions of the Data Protection Act for the processing of the order and the customer service. They can also be used for analysis, market research, quality surveys and improved interaction with our customers. The data you have provided is retained as long as your registration is validated unless you delete it first. You can manage and edit all the information in the protected client area. If you accept your registration, you will receive a registration confirmation email as a subscriber with a portal access code and confirmation that you authorize the monthly reception of our offers and outing tips. You can withdraw your agreement at any time for the processing of data and / or the transmission of data for example by e-mail stating the reason for your request to contact@ecotime-factory.ch

Your rights
You have the right to request information about your personal data at any time. In addition, you also have the right to rectify or erase and limit the processing of your data.

ARTICLE 9 : LAW APPLICABLE TO THE CONTRACT
It is specified that the French version of these terms and conditions prevails. Any translation is provided for convenience only. EcoTime Factory is a company incorporated under Swiss law. Any dispute relating to the interpretation and execution of the Terms and Conditions is subject to Swiss law with jurisdiction in the domicile of the company. In the absence of amicable resolution, the dispute will be brought before the competent civil courts.
